Is Delta 8 THC legal in Kansas? YES!

Delta-8 produced from hemp is tentatively lawful in Kansas. In a divisive opinion, the state's attorney general said that delta-8 products are "illegal" to consume, possess, and sell unless they contain no more than 0.3% tetrahydrocannabinols overall; all delta-8 goods would effectively be illegal with this combined THC content. But state law does not classify delta-8 as a restricted drug. The use, possession, sale, distribution, procurement, and manufacturing of delta-8 goods are all legal under state law, which aligns with federal law specified in the Agriculture Improvement Act (Farm Bill).

Marijuana-derived delta-8, on the other hand, is not permitted in Kansas, which is one of the few states in the United States that prohibits both medicinal and recreational cannabis. Possession of marijuana-derived delta-8 is a Class B misdemeanor that carries a maximum penalty of six months in jail and a $1,000 fine.
