Is Delta 8 THC legal in West Virginia? YES!


Following the passing of House Bill 2694, Delta-8 is no longer classified as a restricted drug in Virginia. The bill made hemp and hemp-derived chemicals, including delta-8, lawful, which means that the use, possession, sale, distribution, and manufacturing of delta-8 products are all permissible under state law. Adult-use marijuana and marijuana-derived delta-8, on the other hand, are illegal under state law. Possession of any amount of delta-8 produced from marijuana is a misdemeanor punishable by 90 days to 6 months in jail and a maximum sentence of $1,000.
