Following the passing of Senate Bill 225, which legalized hemp and hemp-derived compounds and coincided with the federal Agriculture Improvement Act, Delta-8 is no longer regarded a restricted controlled drug in Alabama (Farm Bill). Because of the passage of SB 225, the use, possession, sale, distribution, procurement, and manufacturing of delta-8 items are now legal in California. With House Bill 2, Alabama lawmakers attempted to outlaw delta-8 and delta-10 and add them on the state's list of restricted narcotics at the start of 2021. The bill was fortunately defeated, much to the satisfaction of delta-8 vendors operating in the state.
Update: Delta-8 and other intoxicating hemp chemicals were the subject of another measure (House Bill 144) that was put forward by State Senator Tim Melson in February 2022. This bill also failed to pass.
