Indiana & Delta-8 THC Legality

Senate Bill 156, which matched Indiana's regulations with the federal Agriculture Improvement Act, made hemp and all hemp-derived chemicals lawful (Farm Bill).


Delta-8 survived the State's legislative session of 2022. Sen. Mike Young's introduced Senate Bill 209, later amended by Sen. Liz Brown, which sought to outlaw delta-8 made from hemp due to consumer safety concerns, the bill died due to worries that the phrasing would also prohibit CBD oil.


Hemp-derived delta-8 is now lawful in Indiana, and its use, possession, purchase, sale, distribution, and manufacture are all permissible inside the state's borders, according to state law. However, because medicinal and recreational cannabis are both banned in Indiana, delta-8 produced from marijuana is likewise unlawful. Convictions for marijuana-derived goods in any amount for the first time can result in up to 180 days in prison.
