Following the adoption of House Bill 698 in 2018, hemp-derived delta-8 is now lawful in Maryland and is no longer designated a restricted drug. This measure made hemp and hemp-derived chemicals, such as delta-8, legal.
Following Senate Bill 778, which was approved on May 29, 2022 and went into force on July 1, 2022, hemp-derived delta-8 is now governed by the state's current marijuana regulations. Products containing delta-8 cannot be used, owned, or bought by anybody under the age of 21. A similar restriction applies to anybody under 21 receiving items from a delta-8 company.
