Following the passing of House Bill 459, which broadly legalized hemp and hemp-derived chemicals, including delta-8, delta-8 is no longer classified a banned restricted drug in New Hampshire. Delta-8 is also not officially listed as unlawful under the state's Controlled Substances Act. In New Hampshire, recreational marijuana and marijuana-derived delta-8 are not legal, but they are decriminalized. Possessing modest amounts of marijuana-derived delta-8 products (three-quarter ounces or less) is a civil offense punishable by a maximum punishment of $100.
