New Jersey & Delta-8 THC Legality

Following the passing of Bill A5322, which eventually became the New Jersey Hemp Program, Delta-8 THC is now lawful in New Jersey and is not classified as a prohibited drug under state law. Hemp and hemp-derived chemicals, including delta-8, were made lawful under this initiative. As a result, under New Jersey law, the use, possession, sale, distribution, procurement, and manufacturing of hemp-derived delta-8 are all allowed. After Bill A21 was passed into law in 2021, New Jersey legalized recreational cannabis, which means marijuana-derived delta-8 is now legal in the state.
