Following the passing of Ohio Senate Bill 57, which legalized hemp and hemp compounds, including delta-8, it is no longer classified as a restricted drug under state law. This bill makes it legal to consume, possess, sell, distribute, acquire, and produce delta-8 THC products inside the state without fear of being prosecuted. While medical marijuana is permitted in Ohio, recreational marijuana and the use of marijuana-derived delta-8 for non-medical uses is still prohibited.
