Pennsylvania & Delta-8 THC Legality

Following the enactment of House Bill 967 in 2016, two years before the federal Farm Bill was changed, Delta-8 is entirely lawful in Pennsylvania and is not a restricted drug under state law. This bill made hemp and hemp-derived chemicals, including hemp-derived delta-8, legal across the state. As a result, in Pennsylvania, the use, possession, sale, distribution, procurement, and manufacturing of hemp-derived delta-8 products are all legal and unrestricted.
