South Dakota & Delta-8 THC Legality

All types of cannabis and cannabis-derived chemicals, such as delta-8, delta-10, and CBD, are illegal in South Dakota. Hemp-derived delta-8, on the other hand, is now permitted under state law, which does not expressly list delta-8 as a restricted drug, making its use, possession, sale, distribution, and manufacturing permissible. Marijuana and delta-8 goods made from marijuana, on the other hand, are absolutely prohibited. There is no punishment for possessing 1 ounce or less of marijuana-derived delta-8. Possession of 1-2 ounces of marijuana-derived delta-8, on the other hand, can result in a year in prison and a $2,000 fine.
