Tennessee & Delta-8 THC Legality



Following the enactment of Senate Bill 354, Delta-8 is no longer classified a restricted drug in Tennessee. This bill made hemp and hemp-derived chemicals, such as delta-8, legal. They were also removed from the state's list of prohibited drugs. As a result, under state law, the use, possession, sale, distribution, procurement, and creation of delta-8 items are all legal and unaffected. In Tennessee, marijuana and marijuana-derived delta-8 are illegal and punished under state law. The penalties for using and possessing marijuana-derived delta-8 vary based on the quantity and purpose. Possession of half an ounce carries a maximum penalty of one year in jail and a fine of $250.
